RETURNS AND EXCHANGES POLICY

THE CONSUMER ACT OF THE PHILIPPINES, Republic Act No. 7394 April 13, 1992 implies into consumer contracts certain statutory conditions and warranties that cannot be excluded, restricted or modified. These are in addition to any voluntary warranties offered by the manufacturer or supplier. Where there is a breach of such a warranty relating to goods or services, and the breach is in terms of the Law, a "major" failure, then the remedy will be limited to a cash refund at your election. In all other cases, a breach of such warranty will give rise to a cash refund at our election.
We will refund or offer a purchase, if,for the purchase as the case maybe(with us or you deciding and determining the action to be taken according to whether the failure is major or non-major,as stated above)in the circumstances and to the extent required under the Law if the item you receive does not match the sample or description,is substantially unfit for its intended or disclosed purpose or is not of acceptable equality(as defined in the Law), is unsafe, or if the alleged issue with the product is such that a reasonable consumer aware of the issue would not have acquired the product. Where a refund is to be provided under the terms of this warranty, we may, to the extent permitted under the Law, require the return of the item to us before refunding it. In cases where items need to be sent back, Freshproduce.com.ph will arrange for the pickup of items at the delivery address specified during the order. Refunds will be issued in the form of shop credit, cash, check, by direct deposit, or via the credit card used in original purchase, at our discretion. In order to obtain these remedies you must notify us within 48 hours for grocery items(non-bakery) include but are not limited to frozen goods, meat, seafood, fruits and vegetables, deli, wine, gluten-free items. No cancellation will be allowed for bakery items. Bakery items include but are not limited to pastries, and bread products. At least 75% of the ordered product must be intact. You must contact us at shop@freshproduce.com.ph and provide your proof of purchase, in the form of a receipt,order confirmation e-mail.Once contacted, we will advise the next course of action. We may require that the product be returned (even when partially consumed) for further inspection. We will not accept product returns for no valid reason and when no prior contact has been made with us. Except if and to the extent the Law requires otherwise , refund and reimbursement off reight costs will not be made until the original product is received by us and your claim is verified. We aim to process refunds within 15 working days of receipt by us of the original product. We will not refund or replace a product where,in our reasonable opinion, the product has, following sale to you, become of unacceptable quality due to negligence of food preparation and storage, tampering after unpacking. Limitation of Liability :Where any law implies a warranty into this agreement which may not be lawfully excluded then to the extent allowed by law, our liability for breach of the warranty will a tour option be limited to: there placement of the goods or the supply of equivalent goods; the repair of the goods; the cash payment of the cost of replacing the goods or of acquiring equivalent goods; or the payment of the cost of having the goods repaired. COLORS We have made every effort to display as accurately as possible the colors of our products that appear on Freshproduce.com.ph. However, as computer monitors vary, we cannot guarantee that your monitor's display of any color will be completely accurate. INTELLECTUAL PROPERTY RIGHTS Your use of the Sites and its contents grants no rights to you in relation to any copyright, designs, trademarks and any other intellectual property and material rights relating to the Content (as described in the Content section below), including Freshproduce.com.ph Software and all HTML and other code contained in this Site. All such Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorized by A Freshproduce.com.ph and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. YOUR RIGHTS You have certain rights under the law. These include, in the Philippines: That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site; Certain remedies if a product is defective; and A right to exchange any order of a product within seven working days commencing on the day after the date on which you received it. Noting in the TOS is intended to affect these rights. LIMITS ON OUR LIABILITY Nothing in the TOS is intended to affect your rights under the law (see "Your Rights" above). If Freshproduce.com.ph breaches the TOS we shall only be liable for losses which are direct losses and a reasonably foreseeable consequence of such a breach. Losses are foreseeable where, for example, they could be contemplated by you and Freshproduce.com.ph at the time of you placing your order, and Freshproduce.com.ph dispatching your order. We shall only be liable for losses up to 100% of the total value of goods purchased. We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example,loss of profits or loss of opportunity). We are also not responsible for failure to meet any of our obligations under the TOS where such failure is due to events which beyond our reasonable control. COMPENSATION At our request, you agree to compensate us fully, defend us and hold us Freshproduce.com.ph harmless immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the TOS by you including the use by any other persons accessing this Site using your Internet account caused by your action or inaction. OUR RELATIONSHIP You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and Freshproduce.com.phas a result of the TOS or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of Freshproduce.com.ph, and we shall not be liable for any representation, act, or omission on your part. NO WAIVER If you breach the TOS and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the TOS. GOVERNING LAW The TOS together with all our policies and procedures will be governed by and construed in accordance the relevant Philippine law and the relevant courts of the Philippines will have exclusive jurisdiction.
